Terms of Service

1. Acceptance of Terms

By accessing or using the Delulu app (the "App"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing the App.

2. Use License

Permission is granted to download one copy of the App for personal, non-commercial use only. This is the grant of a license, not a transfer of title, and under this license you may not:

  • Modify or copy the materials;
  • Use the materials for any commercial purpose;
  • Attempt to decompile or reverse engineer any software contained in the App;
  • Remove any copyright or other proprietary notations from the materials; or
  • Transfer the materials to another person or "mirror" the materials on any other server.

3. Account & Authentication

The App uses Apple Sign-In for authentication. You are responsible for maintaining the security of your Apple ID and any activity that occurs under your account. You must be at least 13 years of age to create an account and use the App.

4. User Content

By creating content through the App (such as custom meditation prompts), you agree that your text input will be transmitted to third-party AI services (Anthropic) for meditation script generation, and to ElevenLabs for audio synthesis. Your prompts are stored anonymously and are not linked to your identity.

You represent and warrant that you own or have the necessary rights and permissions to submit any content you provide, and that such content does not violate the rights of any third party.

AI-Generated Content: Content is generated dynamically by AI and is nondeterministic—meaning the same prompt may produce different results each time, and the App may generate content that you did not specifically ask for or expect. Carpincho Labs does not review, approve, or endorse every piece of AI-generated content before it is delivered to you. You acknowledge that AI-generated content may contain inaccuracies, errors, or statements that do not reflect the views of Carpincho Labs.

5. Subscriptions & Payments

The App offers subscription plans managed through Apple's in-app purchase system via RevenueCat. By purchasing a subscription, you agree to the pricing and payment terms presented at the time of purchase.

  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
  • You can manage and cancel subscriptions through your Apple ID account settings.
  • Refunds are handled by Apple in accordance with their refund policies.
  • Prices may change at any time, and you will be notified before any price increase takes effect.
  • Free trials, if offered, automatically convert to paid subscriptions unless cancelled before the trial ends.

6. Prohibited Use

You agree not to use the App to:

  • Generate content that is harmful, abusive, threatening, or otherwise objectionable;
  • Attempt to circumvent any content filtering or safety mechanisms;
  • Use the App in any way that violates applicable laws or regulations;
  • Interfere with or disrupt the App or its servers; or
  • Attempt to gain unauthorized access to any part of the App or its systems.

7. Disclaimer

The App is provided on an "AS IS" and "AS AVAILABLE" basis. We do not warrant that the App will be uninterrupted, timely, secure, or error-free.

The App is not intended to diagnose, treat, cure, or prevent any disease or medical condition. The meditation and manifestation content provided is for wellness and personal development purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified health provider with any questions you may have regarding a medical condition.

The App is not a substitute for therapy, counseling, psychiatric treatment, or any other form of mental health treatment. All content is provided for recreational, entertainment, and personal development purposes only. Carpincho Labs makes no promises, guarantees, or representations that you will achieve any specific results from using the App. You should not make major life decisions based solely on content generated by the App.

8. Limitation of Liability

In no event shall Carpincho Labs be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the App.

Carpincho Labs is not responsible for any decisions, actions, or outcomes that result from your engagement with AI-generated content in the App.

9. Service Availability

Carpincho Labs reserves the right to modify, suspend, or discontinue the App or any part of it at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation of the service.

10. Account Deletion

You may request deletion of your account and all associated data through the App's settings. Upon account deletion, your personal information will be removed from our servers. Anonymous data (such as aggregated analytics) may be retained as it cannot be linked to your identity.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction of our principal place of business, without regard to its conflict of law provisions.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

By continuing to access or use our App after any revisions become effective, you agree to be bound by the revised terms.
